Overview

Welcome to Mellow Mile. The terms "we," "us," and "our" refer to Mellow Mile LLC. Mellow Mile operates mellow-mile.com and all related information, content, features, tools, products, and services (the "Services"). Mellow Mile is powered by Shopify.

These terms, together with the policies referenced in them (the "Terms"), describe your rights and responsibilities when you use the Services. They include warranty disclaimers, limitations of liability, and how disputes are resolved. By visiting or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

Section 1. Access and Account

By agreeing to these Terms, you represent that you are at least 18 years old or the age of majority where you live, and that you consent to any minor dependents using the Services on devices you own or manage.

To browse or purchase, you may be asked for your email, billing, payment, and shipping information. You represent that all information you provide is correct, current, and complete, and that you have the right to provide it.

You are responsible for the security of your account credentials and all activity on your account. You may not transfer, sell, assign, or license your account to anyone else.

Section 2. Our Products

We make every effort to represent our products accurately. Colors and appearance may differ on your screen depending on your device and settings. We do not warrant that the appearance or quality of any product will match your expectations or exactly match what is shown on the Services.

Product descriptions, sizing, and availability may change at any time without notice. We may discontinue any product at any time and may limit quantities offered to any person, region, or jurisdiction.

Section 3. Fiber Content, Care, and Certifications

Fiber content. Fiber content for each product is listed on its product page and garment label. Our tees are made with viscose from bamboo, a regenerated cellulosic fiber. Our organic cotton products are made with organic cotton. If a product page and garment label differ, the garment label controls.

Care. Follow the care instructions on the garment label. Natural and regenerated fibers may shrink, soften, or vary slightly in color and texture between production runs. Damage caused by not following care instructions is not a product defect.

Certifications. Where we reference third party certifications such as GOTS or OEKO-TEX, the certification applies only to the fiber, fabric, or processing step specifically described, and is held by the certified supplier, not by Mellow Mile. Unless expressly stated, finished Mellow Mile garments are not themselves certified. Certification status is set by the certifying body and may change.

Section 4. Not Medical Advice

Our products are apparel. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or condition. Information on the Services about materials, testing, or certifications is for general information only. If you have skin sensitivities, allergies, or a medical condition, consult a qualified healthcare provider before relying on any product.

Section 5. Orders

Placing an order is an offer to purchase. We may accept or decline any order at our discretion. Your order is not accepted until we confirm acceptance and receive payment. Review your order carefully before submitting, as we may be unable to cancel an order once accepted. If we decline, change, or cancel an order, we will attempt to notify you using the email, billing address, or phone number provided.

Returns and exchanges are governed solely by our Refund Policy.

You represent that your purchases are for personal or household use and not for commercial resale or export. Wholesale inquiries should be sent to support@mellow-mile.com.

Section 6. Prices and Billing

Prices, discounts, and promotions may change without notice. The price charged is the price in effect when your order is placed, as shown in your order confirmation email. Unless stated otherwise, prices do not include taxes, shipping, handling, customs, or import charges.

You agree to provide current, complete, and accurate purchase, payment, and account information, and to update it promptly. You represent that (i) your payment information is true and complete, (ii) you are authorized to use the payment method, (iii) charges will be honored by your payment provider, and (iv) you will pay all charges at posted prices, including shipping and applicable taxes.

Section 7. Promotions and Discount Codes

Promotions and discount codes are subject to their stated terms, including dates, eligible products, and minimum quantities. Unless stated otherwise, codes cannot be combined, have no cash value, cannot be applied to past orders, and may be modified or ended at any time. We may cancel orders placed using codes obtained or used in violation of their terms. If promotion terms conflict with these Terms, the promotion terms govern for that promotion.

Section 8. Shipping and Delivery

Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs, weather, or events outside our control. Title and risk of loss pass to you when we transfer products to the carrier. If a package shows delivered but has not arrived, contact us at support@mellow-mile.com within 7 days of the delivery date.

Section 9. Intellectual Property

The Services, including all trademarks, brand names, text, images, graphics, product reviews, video, audio, and their design and arrangement, are owned by Mellow Mile, its affiliates, or licensors and are protected by U.S. and foreign intellectual property laws.

You may use the Services for personal, noncommercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material on the Services without our prior written consent. All rights not expressly granted are reserved.

Mellow Mile's names, logos, product names, designs, and slogans are trademarks of Mellow Mile or its affiliates or licensors and may not be used without our prior written permission. Shopify's name, logo, and marks are trademarks of Shopify. All other marks on the Services belong to their respective owners.

Section 10. Optional Tools

We may provide access to third party tools that we do not monitor or control. These tools are provided "as is" and "as available" without warranty or endorsement, and your use of them is at your own risk. New features added to the Services are subject to these Terms.

The Services may contain links to third party websites or content, including certification bodies and supplier resources. We are not responsible for the accuracy of third party content or for any harm arising from your use of third party sites, products, or services. Direct questions about third party products or services to that third party.

Section 12. Relationship with Shopify

Mellow Mile is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Mellow Mile. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Mellow Mile, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Mellow Mile.

Section 13. Privacy

All personal information collected through the Services is subject to our Privacy Policy, and certain information may be subject to Shopify's Privacy Policy. Because the Services are hosted by Shopify, Shopify collects and processes personal information about your use of the Services. Information you submit may be shared with Shopify and third parties located in other countries to provide services to you.

Section 14. Reviews and Feedback

Reviews. Reviews on the Services are submitted by customers. We do not pay for or condition incentives on positive reviews. If a reviewer received a free product, discount, or other incentive, that will be disclosed with the review. We do not suppress reviews based on rating, but we may remove reviews that are unrelated to the product, contain personal information, or violate this section.

License. If you submit reviews, photos, ideas, suggestions, or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty free license to use, reproduce, modify for length or formatting without changing meaning, publish, and display that Feedback in any medium, including for marketing. We will not change the substance or sentiment of a review.

Your responsibilities. You represent that (i) you own or have rights to your Feedback, (ii) it reflects your genuine experience with the product, (iii) you have disclosed any compensation or incentive received, and (iv) it does not violate any third party right or contain unlawful, abusive, or obscene content or malware. You may not use a false identity or mislead anyone about the origin of Feedback. We have no obligation to keep Feedback confidential, pay for it, or respond to it.

Section 15. Errors, Inaccuracies, and Omissions

The Services may occasionally contain errors in product descriptions, pricing, promotions, shipping charges, transit times, or availability. We may correct errors, update information, or cancel orders if information is inaccurate, at any time without prior notice, including after you have submitted an order.

Section 16. Prohibited Uses

You may use the Services for lawful purposes only. You may not use the Services to: (a) pursue any unlawful or malicious purpose; (b) violate any law or regulation; (c) infringe our or others' intellectual property; (d) harass, abuse, defame, or intimidate our employees or any other person; (e) transmit false or misleading information; (f) send spam or unsolicited promotional material; (g) impersonate any person or entity; or (h) restrict anyone's use of the Services or expose Mellow Mile, Shopify, or users to harm or liability.

You also may not: (a) upload viruses or malicious code; (b) reproduce, copy, extract, sell, or exploit any portion of the Services; (c) collect or track others' personal information; (d) phish, pharm, or pretext; (e) use robots, spiders, scrapers, data extraction tools, AI tools (including agentic AI), or other automated or manual means to access the Services except as permitted in Section 17; or (f) bypass security features, robot exclusion headers, or access restrictions. We may suspend or terminate your account without notice for any violation.

Section 17. Agents

17.1 This section applies if you use, enable, or deploy an Agent to access or interact with the Services. "Agent" means any software or service that takes autonomous or semiautonomous action on behalf of any person or entity without direct supervision.

17.2 No Agent may access or interact with the Services unless it identifies itself and complies with Section 17.4 at all times, or if we have asked it to stop.

17.3 We may limit, including by technical measures, whether and how any Agent accesses the Services.

17.4 Agents must: (i) identify themselves in every HTTP/HTTPS request by including "Agent/[agent name]" in the user agent string; (ii) not conceal that activity comes from an Agent, including by mimicking human behavior or completing or circumventing CAPTCHAs; (iii) respond truthfully when asked whether interactions come from a human or a computer; and (iv) not circumvent any measure intended to block, limit, or control Agent access.

Section 18. Termination

We may terminate these Terms or your access to the Services at any time without notice. You remain liable for all amounts due through the termination date. Sections 3, 4, 9, 14, and 18 through 26, and any provision that by its nature should survive, continue after termination.

Section 19. Disclaimer of Warranties

Information on the Services is provided for general information only. We do not warrant its accuracy, completeness, or usefulness, and any reliance on it is at your own risk.

EXCEPT AS EXPRESSLY STATED BY MELLOW MILE, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NONINFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE. SOME JURISDICTIONS DO NOT ALLOW THESE DISCLAIMERS, SO THEY MAY NOT APPLY TO YOU.

Section 20. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MELLOW MILE, SHOPIFY, AND THEIR RESPECTIVE AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SUPPLIERS, SERVICE PROVIDERS, AND LICENSORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THEIR POSSIBILITY.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES OR ANY PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

Section 21. Indemnification

You agree to indemnify, defend, and hold harmless Mellow Mile, Shopify, and their affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys' fees, payable to a third party arising from (1) your breach of these Terms, (2) your violation of any law or third party right, or (3) your use of the Services.

We will notify you of any indemnifiable claim, though failure to notify promptly relieves you of your obligations only if you are materially prejudiced. We may control the defense and settlement of the claim at your expense, but will not settle a claim requiring nonmonetary obligations from you without your consent, which you will not unreasonably withhold. You will cooperate in the defense, including by providing relevant documents.

Section 22. Dispute Resolution and Governing Law

Informal resolution first. Before filing any claim, you agree to email support@mellow-mile.com with a description of the dispute and the relief sought. We will try in good faith to resolve it within 30 days.

Governing law and venue. These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules. Any claim not resolved informally will be brought exclusively in the state or federal courts located in Harris County, Texas, and you and Mellow Mile consent to personal jurisdiction and venue there.

Section 23. Severability

If any provision of these Terms is found unlawful, void, or unenforceable, it will be enforced to the fullest extent permitted by law, and the unenforceable portion will be severed without affecting the remaining provisions.

Section 24. Waiver; Entire Agreement

Our failure to enforce any right or provision is not a waiver of it. These Terms and any policies posted on the Services are the entire agreement between you and us regarding the Services and supersede all prior agreements and versions of these Terms. Ambiguities will not be construed against the drafting party.

Section 25. Assignment

You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. Any attempt to do so is void. We may assign these Terms without notice or consent.

Section 26. Headings

Headings are for convenience only and do not affect the interpretation of these Terms.

Section 27. Changes to These Terms

The current version of these Terms is always available on this page. We may update or replace any part of these Terms by posting changes to the Services. We will notify you of material changes as required by applicable law, and changes take effect on the date stated in the notice. Continued use of the Services after changes are posted means you accept them.
